This agreement tells you (“The Client”) about the terms and conditions (“Terms”) for any services we offer on our website (“Services”)
By ordering any of our Services, you agree to be bound by these Terms.
You should print a copy of these Terms for future reference.
We may amend these Terms from time to time. If the terms are amended we will let you know, if the client does not want to continue their services due to the updated terms, the client can cancel their account and/or services they use without any charge, or delay.
For every service you order, you will receive free support for issue directly relating to the service you have ordered. we cannot guarantee that we can provide support for issues regarding third party software you use on your service.
We provide 24/7 support for all our services, we will aim to respond to all requests within 24 hours however requests will usually be responded to withing 3 working hours.
We prioritise support requests if they are marked as urgent, is the client abuses our priority feature, the will no longer be able to use this feature and as such their support requests will not be prioritised.
When you first open an hosting account, we will transfer your existing websites to our servers free of charge.
After the introduction period, each additional transfer will be charged at £14.99
We provide the clients with a client area to manage their services & domains. we also provide a knowledge base on how to use the client area.
if the client has any issue with the client area they can contact support for help.
Our services are provided to host business or personal websites or software solutions. We have a strict policy on what is not allowed to be hosted on our services;
Any account with illegal content, pornography, Malware, spam, phishing websites will be suspended until the content is removed. The client will be sent an email describing what content is to be removed.
Content identification is at the sole discretion of Diffusion Hosting.
We operate an ‘unlimited’ service, meaning we do not actively limit your account on disk space or bandwidth. However, this is subject to fair use and any customer using an amount of monthly bandwidth or disk space deemed excessive in comparison to the average usage by other customers on our platform may, at our discretion, be advised to upgrade to a bespoke solution and billed accordingly.
We provide a free backup service however we do not provide warranty for the backup or guarantee that the backup is usable, hence we advise the client to ensure that they backup their account.
We will not be held liable if any data is lost, deleted and/or permanently unrecoverable.
By the Account Activation Date of each month, we shall deliver, via e-mail or post, an invoice in accordance with the applicable Service Fees for services to be rendered in the forthcoming month.
When an invoice is delivered to the client, payment shall be remitted to us by no later than the specified payment due date. We shall be entitled to immediately terminate this agreement for client’s failure to make timely payments. You will be provided with an invoice on a monthly basis.
We do not record or store customer credit/debit card data but you are able to set up recurring billing through our payment partners (currently Stripe and PayPal) to allow us to take payment for invoices as they become due.
It is your responsibility to ensure that you have sufficient funds to cover any transactions. Failure to make payment will result in up to three overdue notices being submitted to you before your account is suspended and/or terminated.
Accounts suspended for non-payment are liable for termination without notice.
Please note that any over-payments caused by the client will be added as account credit only, any attempts to retrieve the money via a charge back, refund request with the payment provide, will result in you account getting terminated.
Please note that we accept payment by credit/debit card or PayPal only. Other payment methods such as bank transfer or cheque are not accepted as a method of payment.
Domains are completely non refundable due to the fee that we occur when they are registered/transferred.
Domains are exempt from our money back guarantee but we will transfer them to a new host at no additional cost.
If their is an outstanding balance on your account domains cannot be transferred.
Your Domains are registered to you, not Diffusion Hosting.
Uptime and SLA
We offer a 99.9% uptime SLA, we may offer credit to the client calculated by the length of downtime, however this will be offered under goodwill.
We shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our servers going offline or being unavailable for any reason whatsoever.
Furthermore, we shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of our servers; loss of service or any costs incurred due to a configuration or service issue resulting from our provided services.
All damages shall be limited to the immediate termination of service.
